The considering of the case materials is going on.

The public prosecutor Dubkov has submitted the petition for interrogation of the FSB operative staff member, the one, who interrogated the Korean diplomat Cho Son Uh, who had been brought to the FSB office on July 3, 1998 after his detention, and the one who searched the diplomat.

It is essential to notice that these actions roughly infringe the Viennese convention on diplomatic relations of 1961. Moreover they had been carried out before the criminal case was initiated and that's why according to the prosecutor's opinion there was no law violation and the Moiseyev's report "Russian Policy on the Korean Peninsula", which had been taken from the Korean diplomat, was attached to the case as a material evidence quite legally (such an opinion was announced by the prosecutor during the previous proceeding).

The judge considered such a petition to be inexpedient and turned it down.

The Prosecutor also submitted the petition for a call to court and interrogation of the chief of one of the operative FSB departments (interested party to a conflict) for giving explanations to his letter, in which he tells about the Korean secret services working methods.

The defense party was against this petition because the opinion of this person can not be taken as lawful. If he is a specialist in this field he should submit an expert conclusion.

The judge came to the conclusion that there was no necessity to call this person and the petition was turned down.

The defense party submitted the petition in order that Moscow City Court give the definitions and referring them with a complaint to the Constitutional Court of Russian Federation for considering the question of the irrelevance of laws, used by the Moscow City Court, to Constitution of Russian Federation; it was violation of Moiseyev's constitutional rights and freedoms. The judge left the petitions without any reply.

FSB considers the relations between Korean diplomat Cho Son Uh and Russian Diplomat V.Moiseyev not as relations between two professionals but as relations between two agents because Korean Secret Service use an easy way to contact with its agents: the talk about arrangement of the meetings over the phone, meet in public places, covering them as official meetings.

The announcement of the case materials, which were considered during the first hearing presided by judge Kuznetsova.

The results of expert examination and testimony of the Russian Ministry of Foreign Affairs experts were announced.

The defense party expressed the opinion that the results of the expert examination is a contradiction in terms, groundless and unqualified.

There is enough evidence to say that a new expert examination is badly needed. The opinion of the Supreme Court of Russian Federation that Russian Ministry of Foreign Affairs expert examination had been conducted unprofessionally was confirmed.
